What is a building amnesty (in short)
It is a technical and administrative practice that allows you to regularize interventions carried out without authorization. These can be:
CILA in amnesty (Sworn Notice of Commencement of Works a posteriori)
SCIA in amnesty, in the most complex cases
Cadastral practices and related updates
Each case has its solution. The important thing is not to ignore the problem and rely on a professional who knows what to do and how to do it in a certain timeframe.
Frequently asked questions
What are the risks if I don’t regularize a building non-compliance?
A non-compliant property cannot be legally sold, nor can it access many tax incentives (such as Superbonus, Renovation Bonus, etc.). In cases of inheritance or property division, the non-compliance can cause delays, disputes among heirs, or notarial difficulties.
Moreover, the irregularity may lead to administrative penalties. For a CILA amnesty, for example, a fine of €1,000 is applied, while for a SCIA it can be higher, depending on the type of intervention and the municipality.
Penalties cannot be paid in installments, and delays in regularization can block or postpone already planned transactions.
Can I request an amnesty even if the violation dates back many years?
Yes, in many cases it is possible. However, it is essential to verify whether the intervention can be regularized according to the urban planning regulations in force at the time of construction. A preliminary technical assessment clarifies if regularization is feasible.
Is it possible to obtain an urgent amnesty for a property sale?
Yes, in many cases the procedure can be managed within a timeframe compatible with the sale date, provided the non-compliance is regularizable. Immediate action is crucial to avoid delays or blockages.
Does the amnesty also resolve cadastral issues?
The urban planning and cadastral aspects are connected but distinct. Often, after submitting the amnesty procedure, it is necessary to update the cadastral plan to align the actual situation with the official registers.
How long does it take to complete a building amnesty?
The required time can vary, but generally falls within the following range:
Submission of the procedure
Technical design and documentation (CILA, SCIA, etc.) take from a few days up to 2–3 weeks to be carefully prepared.
Municipal process
After submission to the municipality, there are precise deadlines:
Building permit in amnesty / SCIA in amnesty → 60 days is the maximum time within which the municipality must approve or reject the application; beyond this period, silence-refusal applies.
CILA in amnesty (minor interventions) → the process is shorter in practice, often completed in about 10 working days, including cadastral update.
Cadastral update
After approval, cadastral data must be updated. This step may take an additional 10–15 days, depending on the timing of the Land Registry Agency.
Estimated total duration:
CILA in amnesty (minor interventions): 2 to 4 weeks
SCIA or building permit in amnesty (complex interventions): 2 to 4 months, especially if integrations are needed or there are constraints

Sale blocked by an old extension – Treviso
A client came to our firm because he was about to sell the family home, but during the preliminary phase the notary found an undeclared extension dating back to the 90s.
The sale was at risk of cancellation. We have carried out a check of the current legislation, confirmed the remediation of the intervention and immediately started a CILA in amnesty. At the same time, we took care of the cadastral update to align the documentation.
Thanks to a streamlined and precise process, the sale was completed within the established deadlines.
Legacy complicated by an internal change – Pordenone
Three heirs found themselves having to divide an apartment left in succession, but the cadastral plan did not correspond to the real internal distribution: a wall had been moved decades earlier without official updates.
After conducting an inspection and consulting the regulations, we verified the remediation of the intervention.
The solution? A SCIA in amnesty, followed by a cadastral variation. Everything was resolved without blockages or disputes, allowing the heirs to conclude the division in a certain time.
House with irregular veranda – Trieste
A young couple wanted to access the 110% Superbonus, but a veranda built without permits years earlier prevented them from obtaining the benefit. The risk? Losing months and funding.
After an urgent inspection, we verified the previous building regularity, confirmed the remediation of the work and presented a CILA in amnesty in a short time. At the same time, we updated the cadastral documentation.
